Web Design / Hosting Agreement

Ozark Digital Media retains the right, at our discretion, to terminate any and all parts of the Ozark Digital Media service provided to you, the customer, without refunding customer for any fees paid but net yet accrued, if it is determined that the customer has failed to comply with any of the terms of the Acceptable Use Policy.

1. Ozark Digital Media reserves the right to refuse service to any company that would compromise the integrity of Ozark Digital Media and/or those of Lebanon Publishing Company. We are a local owned and operated family based establishment that upholds the values of the community and its members.
   
   
2. All initial fees and monthly hosting fees must be agreed upon by the customer. These fees are listed in the initial web hosting proposal.
   
   
3. There is a one year contract for hosting services. Should this contract be broken, any remaining months left in the contract period will need to be paid up front. We require at least a one month written notice should you decide to terminate your service.
   
   
4. Accounts are due within 15 days from date of invoice.
   
   
5. Billing statements are mailed to the billing address on file at the first of the month, for the period being billed. For example, statements mailed out on June 1 are for web hosting/design services offered during the month of June.
   
   
6. If a customer’s account becomes 30 days delinquent, hosting services will be suspended and no files will be released to the customer pertaining to their site until the account is paid in full. After 90 days past due, the entire contents of the site will be permanently removed from our server.
   
   
7. There are no partial month refunds. If you have any full month credits on the account, a refund will be provided. If a customer has an advertising account with Lebanon Daily Record or any other entity owned by Lebanon Publishing, this refund will be transferred to the advertising account as a credit.
   
   
8. If you have purchased a hosting package that does not include updates by Ozark Digital Media, a fee of $30.00 per hour will be incurred for updates done by Ozark Digital Media staff.
   
   
9. With every web hosting account comes 5 e-mail addresses at no extra cost.
   
   
10. You may only have one single user session at any given time across the entire network.
    
    
11. We do not offer software support for those maintaining their own site. Please contact the vendor of the software package. If you should need support, our $30 hourly rate will apply
    
    
12. We respect your privacy! Ozark Digital Media will not monitor or disclose the contents of customer’s private communications unless required to do so by law or in the good faith belief that such action is necessary to protect and defend Ozark Digital Media’s online rights or property or under exigent circumstances to protect the personal safety of its customers or the public. The customer’s account, email addresses, and ftp access shall be password protected and the customer shall be solely responsible for maintaining the confidentiality of the customer’s password. All information will be kept strictly confidential and will not be sold, reused, rented, loaned, or otherwise disclosed. Any information you give to Ozark Digital Media will be held with the utmost care, and will not be used in ways that you have not consented to.
    
    
13. Spamming from our servers is not allowed! Spamming includes, but is not limited to (a) the bulk sending of unsolicited messages, or sending of unsolicited emails which provoke complaints from the recipients, and (b) the sending of junk mail.
    
    
14. Your account will be terminated if attempts are made to cause increased traffic levels for malicious purposed. Examples of this are mail bombing, ping flooding and IRC pong flooding, We will NOT tolerate bulk junk mailings of ANY kind! Excessive bandwidth use may also cause customer’s account to be suspended.
    
    
15. Ozark Digital Media and its licensors and contractors disclaim any and all loss or liability resulting from, but not limited to: (a) loss or liability resulting from access delays or access interruptions; (b) loss or liability resulting from data non-delivery or data mis-delivery; (c) loss or liability resulting from acts of god(d) loss or liability resulting from errors, omissions, or misstatements in any and all information or service(s) provided under this agreement; (e) loss or liability relating to the deletion of or failure to store e-mail messages; (f) loss or liability from your inability to use our e-mail service, web site manager service or any component of the subscription service; (g) loss or liability that you may incur in connection with our processing of your application for our services, our processing of any authorized modification to your domain name record or your agent's failure to pay any fees, including the initial registration fee or re-registration fee; or (h) loss or liability relating to limitations, incompatibilities, defects, or other issues not under Ozark digital Media’s sole control.
    
    
16. You agree that your use of our service(s) is solely at your own risk. You agree that all of such services are provided on an “AS IS” and “AS AVAILABLE” basis, except as otherwise noted in this agreement.
    
    
17. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of our services is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

Ozark Digital Media reserves the right to change the User Agreement and Terms of Service at any point without notification to the customer.
